This Refund Policy describes when and how refunds are issued for the paid Thai-mode annual subscription offered by Cultra Lab Limited Partnership. English mode is free and is not covered by this policy. This Refund Policy forms part of our Terms of Service and must be read with our Privacy Policy.
1. The 3-day free trial is your try-before-you-buy
Thai mode begins with a genuine 3-day free trial. No payment method is required to start the trial. Full content is unlocked for those 3 days so you can make an informed decision before committing money. You may cancel at any time during the trial by simply not subscribing; there is nothing to refund because nothing has been charged.
2. After the trial — no refunds on change of mind
If, after the trial, you choose to subscribe via Paddle's checkout, you commit to the annual period. We do not offer refunds on the remaining subscription period if you later change your mind, no longer need the Service, or fail to use it. You can, and always may, cancel auto-renewal from Account → Billing to stop future charges; your access continues to the end of the paid year.
This policy is fair to both sides: you get three days of full, no-cost access to decide, and we get a predictable annual commitment that funds the free English-for-Thais side.
3. When we do refund
We will always refund promptly in the following situations, because these reflect either our own error or mandatory legal obligations:
- Duplicate charge — you were charged more than once for the same subscription period.
- Charged after cancellation — we or Paddle processed a charge after you cancelled.
- Unauthorised charge — the charge was made without your authorisation (e.g. family member using a card without permission).
- Service materially unavailable — the Service was unusable for a prolonged period during your paid year; a pro-rata refund applies.
- Material misrepresentation — the Service materially differs from what was described on the marketing pages at the time of your purchase.
- Statutory rights — any refund right that applies to you under mandatory law, including the Thai Consumer Protection Act B.E. 2522, the Thai Civil and Commercial Code provisions on defective performance, the UK Consumer Rights Act 2015, or the EU Consumer Rights Directive 2011/83/EU cooling-off rules (where you have not waived them at checkout).
4. How to request a refund
Email hello@thaiandenglish.com from the email address on your Account. Describe the issue and include the Paddle receipt number if you have it. We aim to respond within 3 business days. Approved refunds are processed via Paddle back to the original payment method and typically appear on your statement within 5-10 business days, depending on your bank or card issuer. We are not able to redirect refunds to a different account or payment method.
5. Cancellation (separate from refunds)
Cancellation stops future charges; it does not, by itself, mean a refund. You can cancel at any time from Account → Billing. Cancelling during the free trial means nothing is ever charged. Cancelling a paid subscription stops the next annual renewal and your access continues until the end of the current paid period.
6. If we can't agree
If you feel a refund request has not been handled properly, you may:
- contact Paddle directly via paddle.net — as our Merchant of Record they may resolve payment-level disputes independently;
- file a complaint with the Office of the Consumer Protection Board (OCPB) of Thailand at ocpb.go.th;
- for Thai-resident consumers, bring proceedings under the Consumer Case Procedure Act B.E. 2551 in the Thai court nearest to your residence.
7. Abuse
We reserve the right to refuse refund requests that appear to be an abuse of this policy — for example, repeated sign-up-refund cycles, requests tied to breach of our Acceptable Use rules (Terms of Service, Section 6), or requests made more than 12 months after the original charge. Nothing in this section limits your statutory rights under the laws listed in Section 3.
